Does laser hair removal need a medical director in Georgia?

This is the service owners most often assume is exempt. Two exemptions exist; neither one is an exemption from having a physician.

The short answer

Yes. Rule 360-35-.05 removes the on-site supervision and pre-treatment examination requirements for laser hair removal and pulsed light. It does not remove the physician.

Rule 360-35-.07 still requires a non-physician facility to hold a consulting physician agreement, file that physician's credentials, keep the physician available for emergencies, and post the physician's name where patients can see it.

What the hair removal exception actually covers

Under Rule 360-35-.05, an assistant laser practitioner works under the supervision of a Board-licensed physician or a licensed senior laser practitioner, and patients must be examined before treatment by a consulting physician, PA, or APRN. The same rule states that on-site supervision and the pre-treatment exam are not required for laser hair removal and pulsed light treatments.

That sentence is why a Georgia practice can run a hair removal line with a credentialed esthetician and a consulting physician who is not in the room. It is also the sentence practices over-extend.

The facility requirement does not go away

Rule 360-35-.07 attaches to the premises, not the practitioner. A non-physician facility must have a consulting physician agreement in place, file the physician's credentials, keep the physician available for emergency consultation, and post the physician's information with current supervisor details where the public can see it.

The predictable failure mode

A practice builds a lawful hair removal operation, adds a second device — photo rejuvenation, RF skin tightening, body contouring — and keeps the staffing model that only ever applied to the first one. Every laser or energy service other than hair removal and pulsed light requires the exam before the service. See Georgia rules for RF microneedling and energy devices.

How Local Medical Directors helps

We serve as consulting physician for Georgia laser facilities, and through our device and laser rental program can pair a device with the safety program, operator training, and service coverage that have to come with it.

Related questions

If a clinic has a senior laser practitioner, does laser hair removal still need a supervising physician?

Yes, at the facility level. Rule 360-35-.05 lets a senior laser practitioner supervise the assistant laser practitioner day to day, but Rule 360-35-.07 separately requires a non-physician facility to have a consulting physician agreement, file the physician's credentials, keep the physician available for emergencies, and post the physician's information publicly.

Does laser hair removal require a good faith exam in Georgia?

No. Rule 360-35-.05 states that the pre-treatment examination is not required for laser hair removal and pulsed light treatments. Other laser and energy-based services do require an exam before the service.
